These terms explain how winners are selected when Community Pete (“we”, “us”, “our”) runs a random draw for a competition or giveaway using our comment picker tool (the “Draw Tool”). By entering a competition that uses this process, you agree to the terms below.
1. Eligibility
1.1. Entry is open only to individuals who meet the eligibility requirements stated in the specific competition post (including age, location, and any other conditions we publish).
1.2. To enter, you must leave a qualifying comment on the relevant Facebook post, or otherwise be included in the entry pool as described in that competition’s post.
1.3. We reserve the right to disqualify any entry that is fraudulent, misleading, duplicated in breach of these terms, or submitted in violation of the competition rules.
2. Nature of Our Giveaways
2.1. The vast majority of our giveaways (approximately 90%) involve donated prizes. We do not charge entrants to participate, and we do not charge for advertising run on the Community Pete Facebook page.
2.2. In some cases, tickets or prizes are donated to us by artists, bands, promoters, production companies, venues, or event organisers so that we can give them away to our audience.
2.3. Where tickets or access have been provided to us for giveaway purposes, we may publish content on our page promoting that artist, band, production, or event opening — for example, announcing the show, sharing event details, or encouraging our community to attend. This promotional activity is part of our community support model and does not constitute paid advertising. We are not paid to run ads on behalf of third parties in these arrangements.
2.4. The specific prize, promoter, and any conditions attached to donated tickets will be stated in the individual competition post.
3. How Entries Are Collected
3.1. Entries are collected from comments on the designated Facebook post and/or from an imported list of comments provided for that competition.
3.2. Where a competition requires a specific word or phrase in the comment (for example, “ME” or “PICK ME”), only comments containing that text (case-insensitive) will be included in the draw pool.
3.3. Each person is generally permitted one entry per competition. Where we can identify a commenter (for example, via Facebook user ID or profile URL), only their first qualifying comment will count. Multiple comments from the same person do not increase their chance of winning.
3.4. If a commenter’s identity cannot be verified, comments may be treated as separate entries to avoid incorrectly combining different people into a single entry.
4. How Winners Are Selected
4.1. Winners are chosen by random selection from the pool of eligible, deduplicated entries at the time of the draw.
4.2. During the draw, names may be displayed on screen in rotation for a set period. This animation is for presentation purposes only and does not determine the outcome.
4.3. The official winner is the entry selected at random when the draw timer ends. Selection is made using a standard random number process in the Draw Tool, with each remaining eligible entry having an equal probability of being chosen on that draw.
4.4. Where multiple winners are required, each draw is conducted separately. Once selected, a winner is removed from the pool and cannot win again in the same competition session unless the draw is fully reset and run again from the beginning.
4.5. Our decision as to the winner(s) selected by the Draw Tool is final, subject only to verification that the entry was eligible under these terms and the competition rules.
5. Notification & Verification
5.1. Winners may be announced publicly (for example, in a Facebook post, comment, or live draw recording).
5.2. We may contact winners via Facebook or other details available from their public profile or entry.
5.3. We reserve the right to request reasonable verification of identity and eligibility before awarding a prize.
5.4. If a winner does not respond within the timeframe specified in the competition post, or is found ineligible, we may select an alternate winner or redraw at our discretion.
6. Prizes
6.1. Prizes are as described in the individual competition post. Prizes are not transferable or exchangeable for cash unless expressly stated.
6.2. Where tickets or prizes have been donated by a third party, fulfilment may be subject to that donor’s terms (for example, venue entry conditions, age restrictions, or ID requirements at the door).
6.3. We are not responsible for prize unavailability, substitution where necessary with an item of equal or greater value, or delays outside our reasonable control.
7. Cancellation
7.1. We reserve the right to cancel, suspend, postpone, or amend any competition or giveaway at any time — including before a winner is selected — for any reason we consider appropriate. This includes (without limitation) where there are insufficient entries, the prize becomes unavailable, a donor withdraws the prize, technical issues prevent a fair draw, or other circumstances arise beyond our reasonable control.
7.2. If a competition is cancelled, we will notify entrants via the relevant Facebook post or our page where reasonably practicable. No compensation is payable to entrants as a result of cancellation, except where required by law.
8. Transparency
8.1. We may publish or retain records of the draw, including entry counts, winner names, and exported draw materials, for transparency and record-keeping.
8.2. Entry statistics (such as total comments, filtered matches, and unique entries) may be displayed during the draw process.
9. Limitation of Liability
9.1. The Draw Tool is provided to facilitate a fair random selection process. To the fullest extent permitted by law, we are not liable for:
- (a) technical failures, interruptions, or errors during the draw;
- (b) comments not loaded due to platform or API limitations;
- (c) inability to contact a winner; or
- (d) any indirect or consequential loss arising from participation in the competition.
9.2. Nothing in these terms excludes rights or remedies that cannot be excluded under applicable Australian consumer law.
10. Privacy
10.1. Comments and profile information used for the draw are handled in accordance with our Privacy Policy and Facebook’s platform terms.
10.2. Winner names and comments may be published or used in promotional material related to the competition, unless prohibited by law or stated otherwise in the competition post.
11. General
11.1. We may amend these terms for future competitions. The version in effect at the time of the draw applies to that competition.
